Men convicted in quadruple restaurant slaying seek new trial





Boston (AP)  -- A father and son who opened fire and killed four men eating lunch at a Boston restaurant in 1995 are asking for a new trial.

In arguments before the state Supreme Judicial Court Thursday, lawyers for Anthony and Damien Clemente said the jury at their trial should have been allowed to hear evidence of their victims' propensity for violence. 

They say that would show the victims may have been the first aggressors.

The attorneys cited a 2005 SJC ruling that overturned the manslaughter conviction of a Harvard graduate student. 

In that ruling, the court said juries may consider a victim's violent history if it sheds light on a self-defense claim.
